1. About These Terms

These Terms of Service ("Terms") govern your use of the Bonne Santé website and your purchase of products from us. By accessing our website or placing an order, you agree to be bound by these Terms.

Bonne Santé is a small business based in Adelaide, South Australia. These Terms are governed by the laws of South Australia and the Commonwealth of Australia, including the Australian Consumer Law (ACL) as set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth).

2. Products and Descriptions

We make every effort to ensure our product descriptions, images and pricing are accurate. However, as our products are handmade, variations in appearance may occur. We reserve the right to correct any errors and to update product information at any time without notice.

Our products are intended for canine consumption only. They are not intended for human consumption. Please consult your veterinarian if your dog has specific dietary requirements or allergies.

3. Ordering and Payment

  • All prices are displayed in Australian dollars (AUD) and include GST where applicable.
  • An order constitutes an offer to purchase. We reserve the right to accept or decline any order at our discretion.
  • Payment is processed securely via Stripe at the time of ordering. We do not store your payment card details.
  • You agree to provide accurate and complete information when placing an order.

4. Pickup and Delivery

We offer pickup from our Adelaide location and limited local delivery. Delivery availability, timeframes and any applicable fees will be communicated at the time of ordering.

While we endeavour to meet estimated timeframes, delays may occasionally occur due to factors outside our control. We will notify you as soon as practicable if there is a material delay to your order.

5. Refunds, Returns and Consumer Guarantees

Our products come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Due to the perishable nature of our products, we are unable to accept returns for change of mind. If you receive a product that is damaged, defective or not as described, please contact us within 24 hours of receipt and we will work with you to resolve the issue.

6. Intellectual Property

All content on our website — including text, images, logos, graphics, recipes and design — is owned by or licensed to Bonne Santé and is protected by Australian and international intellectual property laws. You may not reproduce, distribute, modify or create derivative works from any content on our website without our prior written consent.

7. Use of the Website

You agree to use our website only for lawful purposes and in a manner that does not infringe the rights of, or restrict or inhibit the use and enjoyment of, the website by any third party. Prohibited conduct includes, but is not limited to:

  • Attempting to gain unauthorised access to our systems or data.
  • Introducing malicious software (viruses, trojans, worms, etc.).
  • Scraping, data-mining or using automated tools to extract content from the website.
  • Misrepresenting your identity or affiliation with any person or entity.

8. Limitation of Liability

To the maximum extent permitted by law, Bonne Santé excludes all liability for any loss or damage (including indirect, incidental or consequential loss) arising out of or in connection with your use of our website or purchase of our products, except where such liability cannot be excluded under the Australian Consumer Law.

Nothing in these Terms is intended to exclude, restrict or modify any consumer guarantee or right you may have under the Australian Consumer Law or any other applicable law that cannot be excluded, restricted or modified by agreement.

9. Privacy

Your use of our website is also governed by our Privacy Policy, which explains how we collect, use and protect your personal information. By using our website, you consent to the collection and use of information as described in that policy.

10. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a revised "Last updated" date. Your continued use of our website after changes are posted constitutes acceptance of the revised Terms.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of South Australia and the Commonwealth of Australia. Any disputes arising under or in connection with these Terms will be subject to the exclusive jurisdiction of the courts of South Australia.
